Biometric Information Notice

This Biometric Information Notice supplements and is part of the HackerRank Privacy Policy with respect to HackerRank’s collection and processing of Biometric Information. Please check our Privacy Policy for any capitalized terms that are not separately defined in this Notice; those capitalized terms here will have the same definition as within the Privacy Policy.

What is Biometric Information?

“Biometric Information” within this Notice and the Privacy Policy includes “biometric data” and “biometric information” as those terms are defined by applicable law. Where the legal definition of Biometric Information is based on a “biometric identifier,” the term biometric identifier means as defined by applicable law. Biometric Information generally includes data related to your physical, psychological, biological, or behavioral characteristics that is used to establish your identity, such as imagery or scan of your face or facial geometry, iris, retina, fingerprint, hand, or palm or voice recordings.

Biometric Information is considered “sensitive personal information” under the CCPA and similar data protection laws and one of the “special categories of personal data” under the GDPR.

When Does HackerRank Collect Biometric Information?

HackerRank only collects Biometric Information in its role as a processor/service provider providing its Services to an Employer. In providing our Services, we only collect Biometric Information from Candidates and only in certain circumstances.

Whether or not we collect your Biometric Information depends on whether you participate in a Candidate Feature for which the Employer has enabled functionality that collects Biometric Information. If the Employer has enabled the collection of Biometric Information within a Candidate Feature, then we will ask for your consent to collect Biometric Information before you participate in that Candidate Feature. If you consent, then we will collect and process your Biometric Information.

What Biometric Information Does HackerRank Collect and Process?

HackerRank’s Candidate Features allow Employers to enable the collection and processing of the following Biometric Information:

Why Does HackerRank Collect and Process Biometric Information?

We collect and process Biometric Information for the purpose of providing our Services to the Employer who has enabled the collection of Biometric Information. We use Biometric Information only for the purposes for which it was collected.

How Do We Collect and Process Biometric Information?

If you participate in a Candidate Feature that collects and process Biometric Information, then we collect and process Biometric Information as follows:

Our Services capture your facial image taken from your webcam or device at intervals during your participation in a Candidate Feature. We use software to analyze those images to verify your identity for the purpose of validating that you are the actual and only person participating in the Candidate Feature.

HackerRank utilizes Amazon Rekognition, provided by AWS, to process your facial image Biometric Information. You can find more information about Amazon Rekognition here: Amazon Rekognition.

How Does HackerRank Store and Protect Biometric Information?

HackerRank stores, transmits, and protects your Biometric Information using the reasonable standard of care within HackerRank’s industry and in a manner that is the same as or more protective than the manner in which HackerRank stores, transmits, and protects other confidential and sensitive information. We use industry-standard encryption and access controls. We only retain Biometric Information for as long as necessary to fulfill the purposes for which it was collected or as required by law.

How Does HackerRank Disclose Biometric Information?

We only disclose your Biometric Information to the following third parties and only in connection with our provision of Services to the applicable Employer:

to the Employer; and
to our Subprocessors as necessary to provide to the Employer our Services that process Biometric Information.

HackerRank’s Retention of Biometric Information

We intend to retain your Biometric Information for as long as permitted by our agreement with the Employer or for such other time as may be required or permitted by applicable law.

For Candidates located in Illinois, in accordance with Illinois law and unless a different retention period is required or permitted by applicable law, HackerRank will retain your Biometric Information (including biometric identifiers) only until the first of the following occurs, at which time we will destroy your Biometric Information:

the initial purpose for collecting or obtaining such biometric data has been satisfied; or
3 years following your last interaction with HackerRank.

Your Rights in Your Biometric Information

You have the right to:

request access to your Biometric Information that we have collected and stored;
request that we delete your Biometric Information; and
object to the collection or use of your Biometric Information.

Modifications to This Notice

We reserve the right to modify this Biometric Information Notice at any time. Any changes will be posted on our website and will be communicated to you in accordance with applicable law.
