This Artificial Intelligence Addendum supplements and is made part of the agreement between HackerRank and Customer governing Customer's use of the HackerRank Services (the "Agreement"). Capitalized terms used but not defined in this Addendum have the same meaning as within the Agreement.
1. AI Features. "AI Features" means features or functionality of the Services that make use of artificial intelligence, machine learning, or similar technologies.
2. Input and Output. As between HackerRank and Customer, all data, information, content, and materials that Customer inputs into the AI Feature (“Input”) and that the AI Feature outputs based on the Input (“Output”) are Customer Data owned by Customer. Due to the nature of AI Features, Customer acknowledges that Output provided to Customer may be similar or identical to Output independently provided to and owned by other customers and/or users.
3. AI Providers. Certain AI Features may use underlying artificial intelligence or machine learning systems or models developed or provided to HackerRank by third parties (each, an “AI Provider”) as described in the Documentation. To the extent an AI Feature is provided by an AI Provider, the applicable AI Provider will process the Input and provide the Output.
4. Restriction on Training. HackerRank will not use Customer Data to develop, train, or improve any AI Features. And HackerRank does not permit any AI Provider to use Customer Data to develop, train, or improve any AI Provider’s own artificial intelligence, machine learning, or any other systems or models.
5. AI Disclaimer. Customer acknowledges and agrees that: (i) due to the nature of artificial intelligence and machine learning, information generated by AI Features may be incorrect or inaccurate; (ii) the AI Features are not intended as a substitute for human discretion or human decision making, and Customer is solely responsible for ensuring human oversight and validation in connection with Customer's use of the AI Features; and (iii) Customer is solely responsible for verifying the Output is suitable for Customer's intended use and for all decisions Customer makes based on the Output.
